These Terms and Conditions ("Terms") govern access to and use of the website nomadlifecy.com and all associated pages, content, and services (together, the "Platform"), operated by Kristine Belevica, a sole trader registered in the Republic of Cyprus ("Company", "we", "us", or "our").
By accessing or using the Platform, submitting an enquiry, creating a listing, or otherwise interacting with the Platform in any way, you ("User", "you") agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Platform.
1. Definitions
"Listing" means any advertisement for a property, vehicle, service, or other item published on the Platform.
"Partner" or "Advertiser" means any third party — including property owners, landlords, letting or sales agents, car rental or car hire businesses, individual car owners, or service providers (e.g. clinics, salons, water delivery companies) — who submits a Listing to the Platform, whether under the free or premium tier.
"Content" means all text, images, pricing, and other material appearing in a Listing or elsewhere on the Platform.
"Enquiry" means any message, form submission, or contact request a User sends through the Platform in relation to a Listing.
2. What the Platform Is — and Is Not
2.1 The Platform is an online advertising, classifieds, and lead-generation directory. Its sole function is to allow Partners to publish Listings and to forward Enquiries submitted by Users to the relevant Partner.
2.2 The Company is not, and nothing on the Platform or in these Terms should be construed as making the Company:
(a) a licensed real estate agent, estate agency, property broker, letting agent, or property manager, and the Company does not hold a licence under the Real Estate Agents Law of Cyprus or any equivalent legislation in any jurisdiction;
(b) a car rental, car hire, or vehicle leasing business, and the Company does not own, operate, insure, maintain, or hold any licence or permit to rent or hire out motor vehicles;
(c) a provider of any medical, dental, beauty, wellness, delivery, or other service advertised under the "Services" category, and the Company holds no professional licence, accreditation, or qualification in respect of any such service;
(d) a party to, guarantor of, or participant in any sale, tenancy, rental, hire, service, or other agreement or transaction concluded between a User and a Partner ("Third-Party Transaction");
(e) an insurer, escrow agent, payment processor, or holder of any client money, deposit, or rental payment in connection with any Listing.
2.3 The Company advertises third-party offers; it does not sell, let, rent, or supply them.
2.4 The Platform does not process bookings, reservations, or payments. All arrangements, bookings, contracts, and payments relating to a Listing are made directly and exclusively between the User and the relevant Partner, on whatever terms the User and Partner agree between themselves. The Company is not a party to that agreement and assumes no obligations or liability under it.
3. Listings and Advertising Model
3.1 Listings are submitted by Partners on a self-service basis under a free ("Standard") or paid ("Premium/Featured") tier. The Company may charge Partners a flat listing or promotion fee; it does not, as a rule, take a commission calculated on the value of any completed sale, tenancy, or rental — but Users should assume that any given Listing is a paid advertisement, and that Premium Listings receive greater visibility because the Partner has paid for it, not because the Company has vetted, endorsed, or rated the underlying property, vehicle, or service more highly than any other.
3.2 The Company does not independently verify, inspect, appraise, authenticate, or investigate: (a) a Partner's identity, licensing, insurance, or legal right to advertise, sell, let, or hire out the item in question; (b) the accuracy, completeness, or currency of any price, description, photograph, availability, or specification in a Listing; or (c) the condition, safety, legality, or fitness for purpose of any property, vehicle, or service advertised. All such matters are the sole responsibility of the Partner who submitted the Listing.
3.3 Listings are provided for general informational purposes only and do not constitute an offer capable of acceptance, a recommendation, a valuation, financial or investment advice, or a guarantee of availability. Any figures shown (e.g. price per night, daily rental rate, sale price) are indicative only and must be confirmed directly with the Partner.
4. User Responsibility and Due Diligence
4.1 You are solely responsible for exercising your own judgment and carrying out your own due diligence before entering into any Third-Party Transaction, including — as applicable — verifying: property title, ownership, and any encumbrances; the seller's or landlord's identity and legal authority to sell or let; planning and building permits; the car rental company's licensing, insurance coverage, and the roadworthiness of any vehicle; and the qualifications, licensing, and insurance of any service provider.
4.2 We strongly recommend that Users engage independent, appropriately licensed professionals (e.g. a licensed real estate agent or lawyer for property transactions, an insured rental operator for vehicles) where appropriate, and never send money, deposits, or personal identification documents to a Partner without independently confirming the Partner's legitimacy.
4.3 Any dispute, claim, loss, or damage arising from a Third-Party Transaction — including non-delivery, misrepresentation, property or vehicle defects, personal injury, service quality, fraud, or non-refund of deposits — is a matter strictly between the User and the Partner. The Company is not responsible for resolving such disputes, though we may, at our discretion and without obligation, assist in facilitating communication between the parties.
5. Advertiser (Partner) Obligations
5.1 By submitting a Listing, a Partner represents and warrants that: they hold all licences, permits, insurance, and legal rights required to advertise and to enter into the underlying transaction (including, where applicable, any real estate agent licence, car rental operator permit, or professional/service licence); all Content submitted is accurate, current, and not misleading; and they will honour the terms of any transaction agreed directly with a User.
5.2 The Company reserves the right, but has no obligation, to remove, suspend, or refuse any Listing at its sole discretion, including where it reasonably suspects a breach of these Terms or applicable law.
6. Referral and Advertising Compensation Disclosure
The Company may receive a fee, subscription payment, or other compensation from Partners in exchange for publishing, promoting, or featuring their Listings, and may participate in affiliate or referral arrangements with third parties. Such compensation does not constitute an endorsement, verification, or guarantee of any kind regarding the advertised property, vehicle, or service.
7. Third-Party Links and Content
The Platform may contain links to third-party websites, social media pages, or services (including Partner websites and payment or booking pages operated by third parties). The Company does not control and is not responsible for the content, accuracy, security, or practices of any third-party site. Access to any linked site is at your own risk.
8. Intellectual Property
8.1 The Platform's design, layout, logos, and original text and graphics (excluding Partner-submitted Content) are the property of the Company or its licensors and may not be reproduced without prior written consent.
8.2 By submitting a Listing, a Partner grants the Company a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute the submitted Content on the Platform and in related promotional materials, and warrants that it holds the rights necessary to grant this licence.
9. Prohibited Use
You agree not to: use the Platform for any unlawful purpose; submit false, fraudulent, defamatory, or infringing Listings or Enquiries; scrape, harvest, or systematically extract data from the Platform without prior written consent; impersonate any person or entity; or interfere with the security or normal operation of the Platform.
10. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Platform and all Listings and Content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including — without limitation — implied warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or that the Platform will be uninterrupted, secure, or error-free. The Company does not warrant or guarantee the outcome of any Third-Party Transaction.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, goodwill, or opportunity, arising out of or in connection with: (a) your use of, or inability to use, the Platform; (b) any Listing, Content, or Enquiry; or (c) any Third-Party Transaction, act, omission, negligence, misrepresentation, or default of any Partner.
11.2 To the maximum extent permitted by applicable law, the Company's total aggregate liability to any User arising out of or in connection with the Platform and these Terms, however arising, shall not exceed €100 (one hundred euro).
11.3 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the laws of the Republic of Cyprus or applicable EU law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded as a matter of law.
12. Indemnification
You agree to indemnify and hold harmless the Company, its owner, and any personnel from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of: your breach of these Terms; your use of the Platform; any Content you submit; or any Third-Party Transaction you enter into, except to the extent caused by the Company's own fraud or wilful misconduct.
13. No Professional Advice
Nothing on the Platform constitutes legal, tax, immigration, financial, real estate, or medical advice. Content relating to relocation, property, or services in Cyprus is provided for general informational purposes only. Users should seek independent, qualified professional advice before making any relocation, property, financial, or service-related decision.
14. Privacy
Our processing of personal data is described in our Privacy Policy.
15. Suspension and Termination
We may suspend or terminate your access to the Platform, or remove any Listing or Content, at any time and without notice, including where we reasonably believe these Terms have been breached.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
17. Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. Subject to any mandatory consumer-protection rules that entitle you to bring proceedings in your own country of residence, the courts of the Republic of Cyprus shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
19. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Platform.
20. Eligibility
You must be at least 18 years old to use the Platform or to submit an Enquiry.
